BAWAC, Incorporated (BAWAC), in committing to keep your confidence and trust, has privacy polices to protect your personal information. Please note that BAWAC has more restrictive privacy and confidentiality policies that go beyond typical online privacy policies, and an excerpt that relates to consumer privacy may be reviewed below. The Terms & Conditions and User Agreement may also be reviewed below. BAWAC reserves rights of policy modification without notice.

Commitment to Security
BAWAC encrypts information wherever BAWAC requests it online. Personal information is accessible only by staff and volunteers designated to handle online contacts. All BAWAC agents and contractors with access to personal information are also bound to adhere to this policy as part of their contracts.
Personal Information That May Be Collected
BAWAC collects the following types of personal information: names, postal and e-mail addresses, phone and facsimile numbers, billing information, and complaint and inquiry information. BAWAC also collects business information from customers, some of which might constitute personal information, as well as personal information from individuals acting solely in their business capacity.
BAWAC does not collect or maintain information from those actually known to be under the age of 13, and no part of our website is structured to attract anyone under the age of 13.
How Personal Information May Be Used
BAWAC will use your personal information for the purpose for which it was submitted such as: processing & replying to inquiries; processing billing, business, and agency requests related to program participation, customer activity, and/or consumer activity. We may use such information: to provide operational notices; in program recordkeeping; and to conduct research on agency, industry, and/or marketplace practices. Our research may lead to the publication of aggregate demographic data but will not result in the reporting or publication of any personal information provided to us. At certain points where personal information may be collected on our site, there may be a way for you may indicate you would like to be on a list to receive information about other BAWAC programs and services and about ways to support BAWAC. At any time you can add or remove your name from our mailing list by informing us by any of the methods shown on the contact page, but writing or e-mailing is preferred.
How Your Information May Be Shared
BAWAC may also share your personal information for mission related and/or research purposes. BAWAC research will not result in the reporting or publication of any personal information. BAWAC never sells or rents personal information.
We will release personal information under the following circumstances:
- where release is required by law (for example, a subpoena) or regulation, or is requested by an agency for governmental investigative purposes or governmental proceedings;
- where our records indicate or we suspect fraudulent activity or other deceptive practices that should be reported to a governmental agency;
- to appropriate governmental authorities or appropriate persons, where your communication suggests possible harm to others.
- We are required by law to report certain forms of abuse when: we are aware of it, suspect that such abuse may occur, or suspect that such abuse has occurred.

If your personal information changes or you would like to review the personal information we may have on file, please email us with the new information or your review request at info@BAWAC.org or call 859-371-4410. Let us also know the program that led to your submission of personal information so we may efficiently locate your information.
Computer Tracking and Cookies
Our web site is not set up to track, collect or distribute personal information not entered by its visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our site. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information.
A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer's hard drive. Our site may use non-identifying cookies to provide easier site navigation and access to forms. You can still use the site if your browser is set to reject cookies. Our cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you.

The following is excerpted from BAWAC’s Policy & Procedure Manual:
CONFIDENTIALITY & PRIVACY POLICY
It is the policy of BAWAC, Inc. to fully comply with or exceed the protections afforded to consumers under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This insures that the individual’s Protected Health Information (PHI) is properly protected.
The Privacy Rule: protects all “individually identifiable health information” held or transmitted by BAWAC or its business associates, in any form or media, whether electronic, paper, or oral. The Privacy Rule calls this information “protected health information” (PHI). PHI is information including demographic data that relates to:
- The individuals past, present or future physical or mental health or condition,
- The provision of health care to the individual or
- The past, present or future payment for the provision of health care to the individual.
1. The Notice of Privacy Practices will be issued and distributed to all BAWAC consumers. This Notice will outline the basic rights and protections of the individual’s PHI.
2. The President must appoint a “Privacy Official” who is responsible for developing and implementing the privacy policies and procedures and a contact person who is responsible for receiving complaints and providing individuals with information on BAWAC’s privacy practices.
3. BAWAC will train all personnel, staff, students, volunteers, on its privacy policies and procedures as necessary and appropriate for them to carry out their functions.
4. Violation of the established privacy policy and procedures is subject to disciplinary action including termination.
5. Mitigation: BAWAC will attempt to mitigate to the extent practicable, any harmful effect it learns was caused by use or disclosure of PHI by its personnel, in violation of its policies and procedures or the Privacy Rule.
6. BAWAC will maintain reasonable and appropriate administrative, technical and physical safeguards to prevent intentional or unintentional use or disclosure of PHI in violation of the Privacy Rule and to limit its incidental use and disclosure.
7. Complaints: Consumers or persons served may contact the Privacy Officer, the Director of Services, Administrative Manager or President, or the use the grievance procedure, to complain about BAWAC’s compliance the Privacy Rule.
8. Retaliation and Waiver: BAWAC will not retaliate against a person for exercising rights provided by the Privacy Rule, for assisting in an investigation by Health and Human Services or other appropriate authority, or for opposing an act or practice that the person believes to in good faith violates the Privacy Rule.
9. BAWAC will maintain, until six years after the later of the date of their creation or last effective date, its privacy policies and procedures, its privacy practices notices, disposition of complaints, and other actions, activities, and designation that the Privacy Rule requires to be documented.
